This Privacy Notice (this "Notice") concerns you as a user of the Tunez Hub App and Services ("Tunez Hub"), including if you are using Tunez Hub as a Provider or Receiver. It concerns the information we collect from you to provide Tunez Hub – please read it to learn how we handle it.

By using Tunez Hub and submitting personal information, you agree to how we handle your information according to this Notice. If you do not agree to this Notice, we are sorry, but your only option is to uninstall the app and refrain from using it. Please also review and agree to all other agreements and policies displayed on the app, including our Terms of Use Agreement.

Definition of key terms

  • "Provider" refers to any independent music instructor who advertises and provides music lessons to other users through Tunez Hub.
  • "Receiver" refers to any parent/student who purchases or subscribes to take music lessons from another user through Tunez Hub.
  • "personal information" refers to any information that can identify any individual.
  • "users","you", or"your" refers to any individual accessing and using Tunez Hub – to provide or receive music lessons.
  • "we" or "us"or "our" refers to Moratama LTD CO, the company providing Tunez Hub and responsible for the handling of the information collected about you when you use Tunez Hub.

The information we collect and how

Depending on your use of Tunez Hub, we will collect any information that allows us to provide our services to you, improve the services, secure our services, and comply with the law. We will collect the following information categories:

The information you submit

We collect the information users willingly provide to us when they use and interact with Tunez Hub. This may include creating an account, booking a service, contacting us, participating in our surveys and promotions, submitting content (such as reviews and adverts), making payments, and filling out any other forms on Tunez Hub.

Depending on if you use Tunez Hub as a Provider or Receiver, you may submit the following information:

  • First and Last Name
  • Email Address
  • Phone Number
  • Photos and Videos
  • Social Media Channels and Profiles
  • Login Credentials
  • Payment method information
  • Location and Address
  • Age (or Date of Birth)
  • Social Media Channel
  • Skills, Specialty, and Music Genre
  • Certificates and Documents
  • Student Health Information
  • Etc.

You are not obligated to submit any information on Tunez Hub; however, we may be unable to provide our services without this information.

Information from third-party sources

We may collect information from other sources, including social media accounts, partners, and publicly available sources to further enhance our understanding of your use, verify you, and provide seamless access. For example, we may obtain your name, photo, email address, and any other necessary information you make available (via the social media account settings) and use it to grant you seamless access to use our services and verify your information. In other words, when you sign up or log on to Tunez Hub using Google or similar social media plugins, we will use the information you permit on the social media account to create a profile for you on Tunez Hub. You can always revoke access at any time by deleting the social media account from your account settings area.

The information we collect automatically

When users access and interact with the app and its features, we may collect information automatically through tracking technologies like cookies, pixels, beacons, and third-party tracking tools like Google Analytics. These technologies and tools log information such as the user’s device IP address, geolocation, device ID, and other technical information.

We may also automatically log the details of any transactions between users. This may include the package purchased by a Receiver, time stamps, amount and duration, and payment method used.

  • Cookies and other technologies are tiny pieces of data or code used to track users and make certain features work. Cookies do not harm a device. Cookies and other technologies help us to run Tunez Hub, gather analytics, enable user navigation, and secure the app. We use session cookies and preference cookies. Session cookies are mainly used because they are essential for the operation of Tunez Hub (for example, user navigation, access to secure areas, and recording of sessions). They are automatically deleted when you close the app. Preference cookies are used to remember your preferences, such as language settings and other customizations. They are mainly to improve your user experience.
  • Because we use third-party service providers for services like analytics, marketing, and similar purposes, they may also set their cookies and other technologies. This may include advertising and analytics cookies.
  • You can reject cookies if you do not want them to be used to track your use of Tunez Hub. You can do this in various ways, including using the privacy section of the app under your mobile device settings area. You can also adjust your privacy options via the app settings in your Tunez Hub account. However, please be advised that if you delete essential cookies, it may affect your smooth use of the app.

Your permissions

We may automatically access other information based on your consent and permission. For example, in order to upload or import user videos, certificates, and other media from their devices, we may require access to their gallery; to enable us to provide location-based services (such as matching a Receiver with Providers within their preferred location), we may require you to share your live location; and to enable us to send marketing and administrative updates to you via the app, we may request your permission to enable push notification.

Please be aware that you have the right to revoke any of your permissions at any time. You can revoke access by using the permissions feature under the settings area of your device. The app also has a dedicated settings area for your permissions.

Sensitive information

Some of the information you submit on Tunez Hub (for example, student health status) may be regarded as sensitive under certain privacy laws. Such information is not stored for longer than the purposes for which it is collected are achieved, and we limit our use of such information. For example, we only collect any health status to inform a Provider to help them to decide and prepare.

Information from children

Although children (especially those under 13 years of age) are at the receiving end of a transaction between a Provider and Receiver, Tunez Hub does not solicit information directly from children. Any information to be submitted on Tunez Hub should be done by a parent or legal guardian of a child. Such information is shared between the parent/guardian and the music instructor.

Therefore, individuals under the age of 18 may not directly submit personal information to us or create an account on Tunez Hub. If you are a parent and believe a child has submitted personal information to us, please reach out to us atmoratamaltdco@gmail.comto have it removed.

Why we collect your information

We collect the above information for series of reasons, including but not limited to:

  • successfully matching users based on their preferences;
  • identifying and authenticating users;
  • personalizing Tunez Hub to each user’s preferences;
  • securing accounts and our services;
  • complying with applicable laws and other legal obligations;
  • enforcing our Terms of Use Agreement;
  • processing Receiver payments;
  • managing transactions;
  • keeping records for use in future disputes;
  • facilitating support services and other communications;
  • verifying users to keep Tunez Hub safe;
  • securing the app and Tunez Hub;
  • troubleshooting issues and errors encountered by each user;
  • monitoring user movements, gathering analytics, analyzing trends, and improving Tunez Hub;
  • generally enabling the successful provision of Tunez Hub to all users; and
  • communicating marketing messages that match users’ interests and preferences.

The disclosure of your information

We are committed to protecting the privacy and confidentiality of our users' personal information. This section describes the circumstances under which your information may be available to parties other than Moratama LTD CO.

  • Information shared publicly: Tunez Hub may include public-facing sections where Provider profiles and adverts, including names, and profile pictures are displayed. Providers’ profiles may especially contain information about their services, including any associated business information. By submitting an advert or by creating a profile on Tunez Hub, you acknowledge that this information may be visible to other users of Tunez Hub. Likewise, when users, including Providers and Receivers leave reviews and ratings after a transaction, this information may be displayed publicly on the app to help other users make informed decisions. Reviews may include the user's name, profile picture, and any accompanying comments provided by the user.
  • Information shared between users: If you engage with another user, please limit the type of information you share with them. Their use of your information is not governed by this Notice.
  • Information shared with third-party services and partners:We may share anonymized and aggregated information with third-party analytics and advertising partners for the purpose of analyzing user behavior, optimizing our marketing efforts, and delivering personalized content and advertisements. This information does not personally identify individual users.
    We may engage third-party service providers to perform functions on our behalf, including hosting the app, processing payments, analyzing data, storing data, sending emails, notices, and marketing messages, securing the app, providing customer support, and distributing the app. These service providers may have access to personal information needed to perform their functions but are not permitted to use it for other purposes.
  • Information shared in connection with legal compliance and protection of rights:We may disclose personal information if required to do so by law or in response to lawful requests from governmental authorities or law enforcement agencies. Likewise, we may disclose personal information to protect the rights, property, or safety of our users, employees, or others, including enforcing our Terms of Use Agreement or other agreements, preventing fraud or illegal activities, or responding to claims or disputes.
  • Information shared with entities involved in a Business Transfer:In the event of a merger, acquisition, reorganization, or sale of assets, we may transfer or disclose personal information as part of the transaction. Any such transfer will be subject to appropriate confidentiality and security measures. In the event that any other privacy notice will take over after a business transfer, you will be duly notified prior.
  • Information shared with other entities in connection with a promotion or survey:We may share information with other entities if you enter a promotion, survey, sweepstake, or other program sponsored by third-party entities (for example, a promotion conducted by another entity may require you to register to participate).
  • Information shared at your consent: We may disclose personal information in ways not described under this Notice. In such events, we will only share your information after obtaining verifiable consent from you.

Marketing with your information

We may engage in marketing activities that involve your information and privacy. Our marketing activities may include the following:

  • Email marketing: We may send you marketing messages on features and stuff we think may catch your interest. We may send these marketing messages to the email address you provided when you first interacted with us. However, you have the right to opt out of these marketing messages at any time by using the opt-out instructions provided at the bottom of any email we send to your email address.
  • App push notifications: Based on your consent, we may also market to you by seeking your permission to grant your app push notifications. Likewise, you have the right to opt out of app push notification marketing by simply withdrawing your permission (either via the app settings on your phone or in-app).
  • SMS Marketing: With your consent, we may market offers and features to the phone number you specify (specifically the one you provide when you interact with us). You have the right to opt out of SMS marketing at any time by replying "STOP" to any SMS we send to your phone number.
  • Interest-based advertising: We may engage in advertising practices where information we gather about you automatically, including your searches, views, geolocation, behaviors, interests, and preferences, is used to make advertisement more relevant to you across the app and other websites and apps. We may work with ad networks and analytics providers and share this information with them (mostly anonymously) to enable them to send interest-based advertisements on their platforms. They may combine the information we share with them with the ones they have collected about you on other platforms for this purpose.
    You can opt out of interest-based advertising by adjusting your browser settings to block or limit cookies and tracking technologies. Additionally, many advertising networks offer you a way to opt out of targeted advertising. Please note, however, that opting out of interest-based advertising does not mean you will no longer see advertisements from us or on our services, but it does mean that the ads you do see may not be as closely tailored to your interests.

The security of your information

We understand the importance of safeguarding your personal information and are committed to protecting your privacy and security. This section outlines the measures we have implemented to secure your data against unauthorized access, disclosure, alteration, and destruction.

  • SSL Encryption: To protect the confidentiality of your personal information during transmission, we use Secure Socket Layer (SSL) encryption technology. This ensures that all data transmitted between your device and our app is encrypted and secure.
  • Two-Factor Authentication (2FA): We provide an additional layer of security for your account through Two-Factor Authentication (2FA). This feature requires not only a password and username but also something that only the user has on them, i.e., a piece of information only they should know or have immediately to hand - such as a physical token or a smartphone app - to log in to their account. We strongly encourage our users to enable 2FA to enhance their account's security.
  • Access Control: We implement strict access control measures to ensure that only authorized personnel have access to your personal information. Access is restricted based on the individual’s role within the organization, and employees are granted the least amount of privilege necessary to perform their job functions.
  • Regular Security Audits: Our commitment to security includes conducting regular audits of our security infrastructure. These periodic reviews help us identify and remediate potential vulnerabilities promptly, ensuring that our security measures remain robust and effective.
  • Data Anonymization: Wherever possible, we anonymize user data, particularly in the context of analytics and reporting. By anonymizing data, we ensure that your personal information cannot be used to identify you, further protecting your privacy.
  • Payment Card Data: We do not have access to any payment method information used on our app. Payments are handled by Stripe securely.

While we take extensive measures to secure your data, the security of your information also depends on you. We recommend that you choose a strong password, keep it confidential, and be cautious about giving out information in public areas of the platform, which can be viewed by other users.

The retention period of your information

We retain personal information only for as long as necessary to fulfill the purposes outlined in this Notice unless a longer retention period is required or permitted by law.

  • We retain your account information with us for as long your account is active. Once you exercise your right to delete your account, we take steps to delete your information within 30 days. This duration helps us to account for tax, accounting, internal audits, and legal compliance.
  • We do not retain your credit card on our database. Stripe uses it in accordance with their data retention period. However, we retain the details of transactions for longer periods to manage future claims and disputes.
  • We may retain communications for reasonable periods to address inquiries, improve Tunez Hub, and maintain records of our interactions with users.
  • We may retain anonymized and aggregated analytics information for an indefinite period to analyze trends, track usage patterns, and improve Tunez Hub. The information under this category does not identify any individual.

User privacy rights

We prioritize the privacy and protection of users’ personal information. As a user of Tunez Hub, you have the following privacy rights under US privacy laws, including but not limited to those provided by the State of California, Nevada, Connecticut, Arizona, and Utah. These rights are in addition to any other rights and choices under any section of this Notice.

  • Right to access: You have the right to request access to the personal information we have collected about you. This includes information about the categories of personal information collected, the sources from which it was collected, and the purposes for which it is being used. The "Information we collect: How and Why" section above describes the information we collect, their sources, and uses. California users can read the "California Supplemental Notice" section below for this information.
  • Right to correct: If you believe we are handling any inaccurate information about you, please use the editing function in the profile or setting section of the app to request a correction. For information not in your profile section, please reach out to us via our email address at moratamaltdco@gmail.com.
  • Right to delete: You have the right to request the deletion of your personal information held by us, subject to certain exceptions under applicable law. This includes situations where the information is no longer necessary for the purposes for which it was collected, or if you withdraw your consent for its processing. To request deletion of your personal information, please use the account deletion button under your profile settings. You can also reach out to us via email at moratamaltdco@gmail.com to request deletion of specific information.
  • Right to non-discrimination: You have the right to exercise any of your privacy rights without discrimination from us. This means that we will not deny you goods or services, charge you different prices, or provide you with a different level or quality of services based on your exercise of your privacy rights.
  • Right to data portability: You have the right to request a copy of the information we have about you in a machine-readable format to transfer it to another service provider seamlessly. You can reach out to us at moratamaltdco@gmail.com to exercise this right.
  • Right to opt out of sale: Your location laws may provide you with the right to opt out of the sale of your information for monetary consideration or profit. We do not engage in the sale of personal information for monetary consideration. However, users in Nevada who have used our services can request to opt out of any future sale of their personal information by messaging us at moratamltdco@gmail.com.
  • Right to withdraw your consent: Where you have given us consent to use your information for any specified purpose, you have the right to withdraw your consent. For example, the app will provide you with an option to manage your app push and email preferences in the menu. Once you exercise your preference to withdraw your consent, we will take steps to cease using your information for that purpose.
  • Right to request our limit on the use of sensitive information:You can request that we limit our use of sensitive information to those purposes we collected them for. As already established, we only use sensitive information for the purposes we collect them and we take extra privacy measures to protect them from unauthorized access and disclosure.

California Supplemental Notice

As required by the California Consumer Privacy Rights (CCPA), as amended by the California Privacy Rights Act (CPRA), the categories of information we collect, including their sources, uses, and whom we have shared them with, are listed below:

Categories of information we collect

  • Identifiers: name, email address, phone number, IP address, social account data.
  • Personal information categories listed in the California Customer Records statute: Name, address, telephone number.
  • Commercial information: transaction details.
  • Financial information: credit card information.
  • Internet or other electronic network activity: device IP address, geolocation, device ID, technical information.
  • Location information: geolocation and precise location from device latitude and longitude.
  • Professional information: skills, specialty, genre, certificates, documents.
  • Inferences drawn from personal information: preferences, behaviors, choices.
  • Sensitive information: credit card information.
  • Other information: user-generated content (reviews, feedback).

Sources of information

We may collect the above categories of information through your submissions; automatically through cookies and tracking tools; and from third-party sources.

Information uses

We may use the above information to provide and improve our services; comply with the law and enforce our Terms of Use; secure the app and Tunez Hub; and enable two-way communication.

The disclosure

We may disclose the categories of information to our third-party service providers; other users and the public; law enforcement; other entities; and other third parties at your consent.

Do Not Track signals

We respect users' privacy preferences, including the choice to enable or disable the "Limit Ad Tracking" feature provided by their mobile devices. While the Limit Ad Tracking signals are not universally recognized or implemented, you can configure your device settings to send a Limit Ad Tracking signal if you prefer not to be tracked while using your device online.

At this time, we do not respond to these signals, as there is no industry-standard protocol for interpreting and responding to them. Instead, we adhere to our own data privacy practices as outlined in this Notice.

Links to other services

The app may contain links to other websites, mobile applications, or services that are not operated or controlled by us. These links are provided for your convenience and reference only and do not imply any endorsement of the products, services, or content offered by these third-party entities, nor do we have control over their privacy practices.

When you click on a link to a third-party service, you will be subject to their privacy policies, terms of use, and practices, which may differ from this Notice. We encourage you to review the privacy policies of these third-party services before providing any personal information or engaging with them.

Changes to this Notice

We reserve the right to update or modify this Notice at any time to reflect changes in our practices, legal requirements, or technological advancements. Any updates or modifications will be effective immediately upon posting the revised Notice on the app. We may also communicate changes to you via your account email address or via app push notification

We encourage you to review this Notice periodically to stay informed about how we collect, use, and protect your personal information. Your continued use of Tunez Hub after the posting of any revised Notice constitutes your acceptance of the changes.
